Section Four - Welfare of the Child


The decision to take enforcement proceedings is made on behalf of the
Secretary of State therefore regard must always be given to the welfare of
any child.

Child Support Act 1991 section 2 states that:
' Where in any case which falls to be dealt with under this Act, the
Secretary of State is considering the exercise of any discretionary power
conferred by this Act, he shall have regard to the welfare of any child
likely to be affected by his decision'

To apply this rule to enforcement cases requires careful consideration
because previous misinterpretation of this rule has been one of the reasons
why the Agency has failed to use its powers to the full.

The main consideration for enforcement case officers should always be to
enforce the payment of debt and collect monies for the qualifying child/
children. However, case officers must consider any other children affected
by the decision.

It is important to realise that where legally possible this will have been
recognised within the assessment and therefore each case must be considered
on individual merit.
