I hate to defend a thieving pikey piece of shit like that, but it's
not. As you've already been told, there's nothing illegal about modding
your console. It's what you use it for afterwards that's illegal.
And, as has been pointed out, what reason is there to mod a 360 beyond piracy?
So you can play backups while keeping your original safe.
with my XBox 1 my son played my original collectors edition of Halo 2,
after a couple of months the disk was so badly scratched that it would
not play anymore, I soft modded the console, downloaded the disk image
and let him play that. The next time the disk has stopped playing I
simply burnt another copy.
even if it was a copy of your own disk, and not a downloaded image, it
would probably still be considered as breach of copyright depending on
the terma and conditions.

maybe, instead of just letting your son destroy game discs, you teach
him to look after stuff?
radical idea, i know.
that was a couple of years ago when he was only 4, now he is a lot
better and a lot more careful with disks - now I only have to worry
about his 3 year old sister.
