Elite sctrached my disc

Hi all, I just last week got my first Xbox after being a long time
playstation fan.
I got a nice new elite system and also bought a wireless head set, wireless
bridge, two battery packs with docking station charger and a copy of forza
collectors edition. All of this came from my local Game store and when you
factor in the Netgear wireless router I also bought and my xbox live
subscription the sum total weighs in around the £600 mark.
I have been absolutely delighted with it (hardly touched my PS3 since
getting the xbox) but now I am raging.
I went to play forza yesterday and it wouldn't load. I ejected the disc to
find it had a very deep circular scratch on the playing surface. This disc
was perfect when I bought it just days ago (at a cost of £50) and as it's
the only game I own just now, it has been in the xbox since it I took it out
of it's own box and played no more than 3 times.
I spoke to one of the assistants in Game about this. As the system was less
than a week old, he offered to have the console inspected for defects but
told me he would do nothing about the game as "yeah, they (360's) sometime
do that". So now I'm £50 out of pocket and have an expensive console which
I don't have any games for until pay-day comes around again and I spring for
another forza. What's more, after the Game employees nonchalant attitude
I'm concerned that this will happen again and again - is this how Microsoft
make the money back that they loose on each consoles sold?
Having had a look on the net, I found several other cases like this but most
seem to be caused by moving the console while it's switched on - mine has
not been moved and what's more I've been gaming for nearly 30 years and
never heard of a system that can't be moved while powered up - hell my PS1 &
PS2 have had many a tumble while in use and survived just fine with no
damage to console or disc.
My point is has anybody had this happen and managed to get a resolution that
didn't involve spending more money - either by pressing their retailer or
Microsoft for a replacement. My feelings are that the responsibility lies
with Microsoft rather than game.
