Worryingly their statement that you have 3 months to return faulty software or up to 12 months for a like for like *exchange* of *faulty* hardware seems to be flying in the face of the basic consumer right to obtain a refund for goods that are not of satisfactory quality.

They are not denying anyone basic consumer rights on this matter. Your statutory rights are not affected, you just cannot return a game just because you do not like it. That is within the law.
If people did not treat them like a rental service in the first place they would not have to change it.
Too many people taking the piss.
