The bulk of second hand sales are done at retail. Sony can and will easily enforce it by holding back stock for companies that don't comply.
But the only way Sony will know if it's being done is by sending out people to all of the retailers that ever sell ps3 games!
They do, on a regular basis. Clueless 'reps' come to brief the staff on upcoming software that they know nothing about and to make sure the prime shelf space they pay a fortune for is all as it should be.
And you really think people on the net will keep quiet about it?
