If there's something being investigated that relates to the school or
the pupils, then the head can withhold a reference. Actually, the head
can withhold a reference without any investigation. It's one of the
powers that heads use when they want to get back at someone they don't
like.

The person needs to ask the union to help with an agreed reference.

The dodgy bit is the police involvement (school-related, if it's that
- if NON-school-related, the employee has more leverage on his or her
side). A head teacher or GB can be sued if they give a positive
reference to someone who might have something that would make him
ineligible to teach (child protection, capability, misconduct). They
do have to protect themselves, and their school/GB.

That said, a reference needn't contain anything more than factual
information: "X worked at J school from (year) to (year). X taught
Year groups...." and suchlike. A reference received that is like that
will send up a red flag to the receiving school, usually, unless the
teacher's record (e.g. promotions, awards, results records) show
otherwise.

A friend got a cr*p reference from his head teacher but when the
receiving school saw the promotions he'd received over the years, and
the data he provided on GCSE passes and the like, they ignored it and
hired him anyway.
