Here's the relevant excerpt:

So that just talks about the Service, which is defined earlier to be (essentially) the syncing service.

But above that in the license it says that NNW *may* connect to the Service, but it does not say this is required:

"The Licensed Software may connect to and rely on the Service (as that term is defined herein)."

If you do use the Service you do have to do it via NNW, which seems reasonable. (The bit you quoted.)

It certainly appears to distinguish between using the Software and using the Service, and it certainly seems that using the Service is optional.

It seems alright to me, but I'm not a lawyer. Have you asked the Newsgator folks for clarification? There's an email address at the bottom of the license agreement - info@xxxxxxxxxxxxxx
