Legally they can't do that - your contract is with them, it's their
responsibility to sort it out. If more people insisted on their
consumer rights, or threatened/used the small claims system to get
it sorted, then maybe fewer dodgy dealers would try it on and

In the case of Monitors, the manufacturers have a return and replace
policy Its in your own benefit to deal direct as it saves posting
back to the dealer waiting for him to post to manufacturer and
waiting for him to post it back to you after he receives it from the
manufacturer. Of course you can stand on your rights and wait a week
or two or get it next day.

Even worse if a retailer has bought a load of cheap faulty monitors directly
from a manufacturer and tries to pass them off to the customer as new.
This tends to happen when people sell LCD monitors and say they charge
£30 for it to be checked before they send it to you! What a total con, it's
grade B stick they got cheap. New stock that is not faulty doesn't come
with manufacturing defects such as dead pixels. They try to confuse the
public by suggesting a British Standard of manufacturing applies in the
case of consumer Law when it does not. It in no way excuses a retailer
trying to get away with knowingly selling a faulty product and hoping to
get away with it. Look at how many retailers con the public with extra
charges for checking LCD panels and there are so many complete fools
that pay extra when they could go elsewhere and buy a product that
hasn't previously been returned!
