Section 317(1)(a) ITEPA 2003 affects employers providing free or
subsidised meals in a staff canteen. The provisons of this are that the
costs should be reasonable and available to all. This is also used to
allow for Tea and Coffee and similar in the workplace without incurring
a tax charge.
Just dont have a seperate dining room for executive and staff with £20
per head spent on the executives and £1.50 per head on the staff, HMRC
loses its sense of humour when that happens.
You have also been told about s264 of ITEPA 2003 that exempts up to £150
per head on any one event. if you have more than one annual event, the
the combined costs should not be more than £150 per head. ie, if two
events and cost per head is £70 each then you are ok. If one is £80 per
head and the next £80 per head, even though you may think you have £70
per head spare, if the second event takes the amount over the £150, then
the whole cost of the second event is taxable.
Got it. I also read somewhere that the person's spouse increases that
amount which I thought sounded far too generous. So if myself and my
wife went out for Xmas (which is what I'm looking at just now so it
would just be the one event) would that in fact be £300.00 ?

Gosh I am getting old, i should have spotted a consultant a lot quicker
than this. Must the pain in my hip.

The business was setup when I was a 'contractor' (ie. almost solely
working through agencies). Since moving to a remote part of the
Scottish Highlands at the start of last year working through agencies
is no longer an option so I now have more source of input (software,
hardware, support and still some consultancy).

My wife is not an employee of the business, and as I said at the start
I think the £300.00 sounds far too generous for me and my spouse, and
the way I udnerstood it it was £150.00 per employee (up to a limit)
however I just wanted to check it out.
