I keep telling you guys, people do it all the time.

Sure they do, and I'm sure you can prove it by showing those
people being prosecuted by the ATF for doing so.

Um, the whole problem is, it's hard to enforce, and therefore
prosecute. The gov would have to prove someone is an active
dealer in violation of the law, but since it's legal for "private
sellers" to operate at gunshows it's virtually impossible to prove
someone is a "dealer" in violation of the law. That's the whole
point.

Actually, no, it isn't. Many of the same promoters travel around
the country and set up shows. You have to register for a table at
one. Their records will show you registering at several shows. ATF
also attends all those shows as does local law enforcement. They
can access the dealer's records and, guess what? You just got
nailed for acting as a dealer but having no license to do so. You
have been committing a crime.

Secondarily, if you as an individual are aware of some folks doing
just that, why aren't you turning them in instead of whining about
a loophole in here?

people circumvent the law by private sales at gunshows.

No, that isn't a circumvention either since the sales of firearms
by private individuals is specifically addressed in the law. Now,
if you sell those firearms in enough quantity or often enough to be
classified as a dealer, now, you are committing a crime, not using
a loophole.

Actually I think the legal requisite is you have to be actively
acquiring those guns for resale. If you'd spent 10 years buying 1
gun a week and then started sellig your 520 guns WITHOUT continually
buying more guns you could easily claim to be selling your
collection.

That's true, but certainly a rare exception. The complaint on the
"gunshow loophole" is purely about sales between private individuals
and usually concerns only one or two guns at a time. What rankles
the antis is that there is no background check on that sale in 34
states.

Per the antis it is. It is anyone getting around the Brady check. Per me,
it is someone breaking the law if they are, in fact, acting as dealers
and have no FFL.


But1 but! Doodoo says he bought his guns that way. He is clearly a
criminal! I mean if the seller is a felon it makes sense that the
government shoukld take the proceeds of that sale.

So when is Doodoo going to voluntarily turn in hos guns?
