Re: Constitutional Amendment 28 - Getting Congress to stop restricting commerce

The use by Congress, of the Commerce clause of the US Constitution
has exceeded its original intent. Would you consider reining
Congress in?

Amendment 28 - Commerce among the several States
Commerce being the life blood of a free people and Congress
Constitutionally
bound to regulate same. No law shall be enacted which restricts
commerce among the several States

Actually it is the Interstate Commerce Act of 1887 that Congress
relies upon to regulate business.

Nah, it's the Commerce Clause. See Article I Section 8 Clause 3.
But if you want to get rid of the Congress's power to regulate
interstate commerce you will have to pass a constitutional amendment.

The Commerce Act expanded the Commerce Clause thus giving Congress
the power to regulate business. If they could have regulated business
simply by the terms of the Commerce Clause Congress would not have
bothered to enact the Commerce Act of 1887.

So you're saying this act of Congress effectivly amended Article I,
Section 8, Clause 3, Mr. Frown?

The origional purpose of the Commerce Clause was to prevent the states
from imposing duties and tariffs on goods being sold between the
states. It was not intended to regulate everyday business activities
as the Commerce Act does.

So this is just about guns, right Brownie? Machine guns probably. In-
state only machine guns. Sorry, the ATF says you still need a permit to
manufacture guns, see 18 USC 922(a)(1)(A),(B).

Wouldn't it be easier to pass a constitutional amendment that says
"the right of each citizen to have guns for his or her self-defense
shall not be infringed"?

Why not simply say, "the right of each citizen to keep and bear arms
shall not be infringed." Oh, thats what the 2nd Amendment does say.
Silly me.

No, the Second Amendment says nothing about "persons", which is how the
Founders identified individuals in the Constitution. "The People" has
always meant the whole body of the people, the body politic, etc. You
may be surprised to discover that the Founders used language at a very
high level, yet clear and concise.

It's how the NRA made you believe that the Second Amendment means exactly
the opposite of what it has always meant and still means and will always
mean, that is the measure of your mental incapacity to reason critically.
You are a brainwashed zombie, a Borg with conduit connecting your brain
and your ass. I'm afraid you'll never get over it.

So all I can do to help you is to mock you. I just just want to make
your illness a little worse, a little harder to live with. Why? Because
I like you!

POINT PROVEN!
