Really. I wonder how THAT works.
I think it's a two edged sword. California 'anti-gun-nuts' want more
unreasonable laws based on what is often pure fiction. While the gun
advocates want less laws in general - ideally no laws at all. I think Brown
(who has never been a big advocate of gun control) would like to see the
Supreme Court make a ruling one way or another. He's trying to draw it to a
head - especially given the immanent appointment of Judge Sotomayor to the
Court.
I don't know if this is for a bigger reason, or if it's for what it says in
black and white. Whether citing the 'Unsafe Handgun Act' is a political
ploy, or not, remains to be seen. Maybe... Brown thinks that Sotomayor is
the ultimate deciding vote for 'incorporation' of states laws within the
U.S. Constitution; whether he's betting on incorporation or against it is
still an unknown too.
I think the key is how close Jerry Brown is (behind the scenes) to Senator
Diane Feinstein's wild and often unfounded extreme gun control perspectives.
He may be positioning himself for a run as governor too - since the
Terminator's days are numbered. At any rate if the Supreme Court rules in
favor of incorporation (which it may) then all the states laws on gun
control will need to be re-written accordingly (and the mood of any given
state population will be an influence on newer legislations). It's at best
very complex. It's funny that 32 other Attorneys General have filed similar
briefs, all at the same time. I believe they (all) want a clearer and more
level playing field to interpret the state various laws.
