In addition, it also matters if the project is for-profit or non-
profit, and it matters if the usage might result in loss of sales to
the quoted work. Also, the smaller the original text that the quote is
taken from = the most likely one will need permission to quote. If I
use five or six quotes from Gould's "Structure of Evolutionary
Theory" (2002; 1000+ pages) then I do not need permission as long as I
give proper attribution. But if I use 30 words from a 100 word
newspaper article then I need permission to quote.
I remember this guy published the entire Gerald Ford speech which
pardoned Nixon. Ford sued and won because the guy used the entire
speech and did not have permission. The Court said if so and so used
sporadic short excerpts then it would have been Fair Use.
Ray is, as usual, wrong about this. The case revolved around an
article in The Nation magazine, which had obtained the manuscript for
Gerald Ford's memoirs before the publication date, and quoted from it
in an article. The magazine writer did NOT "use the entire speech"
--- he quoted just one paragraph, 300 words, from the several-hundred
page book. The Supreme Court (Harper and Row Publishers vs Nation
Enteprises, 1985) ruled that it was not "fair use" because it was the
most important paragraph in the whole book (why he pardoned Nixon),
and printing it elsewhere therefore reduced the market and salability
of the entire book.
Previously I said the guy used the ***entire pardon portion*** (that
was the context) and I said if what is used decreases sales then there
will be legal problems (even though it was not you who challenged the
latter).
When the entire pardon portion was used no one then needed to buy the
original source.
Ray, is there ANYTHING, anything AT ALL, that you, uh, actually know
anything about . . . . . ? If THIS is the extent of your, uh,
research ability, it's no WONDER that the IDers you contacted think
you're an idiot and don't want anything to do with you. (sigh)
You completely botched what I said, Reverend Flank. It is not
appreciated.
As for certain IDists: since Jesus was betrayed by an original apostle
and since He said a servant is no better than his Master I do not feel
slighted - the Bible corresponds to reality.
And since the Temple priests paid that apostle to betray his Master we
have an explanation as to why persons who call themselves reverend and
wear collars THINK they are serving God when in fact Jesus said they
are "of their father the devil." Again, the Bible corresponds to
reality, Reverend Flank.
Ray
