There is a difference between "how" a person was unfaithful, isn't there? One can be unfaithful by having sex with someone they got to know, and one could hire a prostitute to have sex with. The first is not an illegal act (as long as they are not underg age, or you did not drug that person), but it is illegal to hire someone to have sex with you.
