Well I've seen the actual portrait at an exhibit, but he is a "Graphic
Artist" and clearly incorporated pieces from other people's works
on many of his canvasses.

But "Fair Use" covers even using the actual photo, if the changes
are significant enough. Secondly, it's an image of Obama. They
don't own Obama's likeness.
