What is a "real business" ? This practice moves them a bit closer to spammer status.
The hard-core spammmer, of course, knows that out of his million victims, 900,000 will never see the spam (decent filters),
90,000 will be furious but powerless, 9,000 will complain bitterly
to an ISP or relay that doesn't care, and the remaining thousand
idiots will ensure that the spammer's effort was profitable.
A real business would be one which is able to trade without the business model outlined in your second para.
I can understand a business wanting to build a community with newsletters etc. but they really do need to be very careful how they go about it. I think in some cases they get approached by digital marketing companies (AKA spammers) who persuade them it would be good business to email customers not realising that the DMC AKA S is only interested in getting paid for sending email and not in the overall effect on the business.
For instance I have a spam in my junk folder sent on behalf of a plumbing merchant I once bought something from. The From and Reply-to headers both have domain names resembling the business but go back to the same address that sent the email which is the 3rd party spammer behind every single link on the email. Anyone wanting to buy will go through the spammer who will, presumably get paid on these results. Any complaints to reply-to will get ditched. The merchant will only see the good stuff and, apart from a trickle of complaints from those who seek out the address on the merchant's website, they'll be in blissful ignorance of the damage they're doing to their reputation with everyone who objects to their spam.
