This discussion is just becoming PARANOID! Believe me, nothing is
going to happen to anyone who publishes the odd birth, marriage or
death certificate on a website or anywhere else. All they are concerned
about is widespread reproduction of BMD data and census returns on the
Internet or CD for commercial purposes and money, which have to be
licensed. They couldn't give a monkey's about individual, ordinary family
historians publishing their private researches.

I find it rather sad that people seem to feel the need to jump through so
many hoops to avoid copyright (where it's significant, or where they think
it's significant) when all they have to do is ASK a copyright holder for
permission. In a long carreer of writing for science and history, I've
never yet known a copyright owner refuse, provided that the article
acknowledges that they've granted permission.
I do the same thing myself - I look after a scientific archive with a huge
collection of unique images. When someone wanted material for the cover of a
wide-selling textbook, they paid a fee (which went to support the archive -
it bought a fire-proof safe), when people want material for non-profit
publications (including a 100th anniversary calender for next year), they
don't. I used to put high-resolution images on the archive's web site. These
days I only use low-res stuff on line because so many people just helped
themselves without asking or even acknowledging where they'd got the images.
I need the feedback to keep proving to the University that the archive is an
important part of their PR, so I keep track (and usually a copy).of
publications using our material with permission.
