Seoul Won't Extradite Vietnamese Dissident

A South Korean court on Thursday rejected the Vietnamese government's
request for extradition of Chanh Huu Nguyen, a Vietnamese dissident.
The Seoul High Court said that it decided not to accept the request,
upholding the view that he is a pro-democracy leader.
Nguyen has been branded as terrorist by the Vietnamese government but
hailed by supporters abroad as pro-democracy leader who has been
dedicated to liberating Vietnam from communism.
Nguyen, 55, has been detained in Seoul since April when the Korean
police arrested him here at the request of Vietnam.
Hanoi has claimed that Nguyen attempted to bomb the Vietnamese Embassy
in Bangkok, Thailand, in 2001 and a statue of Vietnam's national hero
Ho Chi Minh between 1999 and 2000.
``We have decided to regard him as a political dissident,'' the court
said in its ruling.
The court said that the Government of Free Vietnam, a Vietnamese
government-in-exile that Nguyen founded in 1981 in the United States,
is a political institution that is aimed at protesting against the
Vietnamese communist regime and establishing a pro-democracy
government.
``As he has been leading the organization since its foundation with
active pro-democracy movements, we have concluded that he is a
political dissident,'' the ruling said.
The court also said that none of his alleged terrorist acts injured
people or damaged facilities, and noted that Vietnam is not a signatory
of the International Convention for the Suppression of the Financing of
Terrorism.
It turned down prosecutors' claims that Nguyen should be an exception
to the principle of non-extradition of political dissidents.
The decision is interpreted to mean that Korea puts emphasis on abiding
by international law that upholds the principle of non-extradition of
political dissidents, despite possible damage on close economic and
diplomatic relations with Vietnam.
The ruling marks Korea's first rejection of the extradition of a
political dissident.
Under the bilateral extradition treaty, the local prosecution is banned
from appealing Nguyen's case to the Supreme Court, which allows Nguyen
to be released and travel freely.
Kwon Yong-suk, Nguyen's South Korean lawyer, welcomed the ruling.
"The court made the right decision in terms of justice and human
rights. It will reaffirm South Korea's international status as a
country that defends human rights and will do the country good in the
long term,'' said Kwon.
