Re: Elite student 1, Bus-driver 0

Based on what I read it was the bus driver who first got physical.
While pushing here and there it got out of control. The bus driver
is said to have used force that could be interpreted as an attack.

That is why the bus driver should have taken a photograph of the
couple and since the card's details are registered in the machine
it would be easy to pin point the keepers of the card.

However the bus driver decided to break the law. Therefore he
had contributed to the violence as well.

violence? isn't it the boy who hit the bus driver first? In Singapore LKY is
above the law, he can change modify it anytime he wants to suit his needs
and wants. He changed it in the 70s to acquire land for $1 market price,
isn't that clear enough that he can perform magic when he wants to?

You are speaking out of emotions. When in Rome you got
to live like the Romans. Likewise while in Singapore everyone
except the familee and their protectorates has to live in accordance
of the law. By the law the bus driver does not have the legal right
to get more violent than what the law allows. Since the activities of
the bus driver is illegal then the bus driver is also in the wrong.
Don't get me wrong, I am not supporting the boy's action. But based
on the facts that the bus driver violated the penal code and the
constitution of Singapore, one have to give the benefit of the doubt
to the boy in view of self defence.

One cannot deny based on the newspaper report that :
The driver is guilty of spoiling public peace.
Obstruction of path.
Unconstitutional detainment

If violence should be avoided then all should avoid.
Should society condone violence of bus drivers over
petty issues like tempered bus cards. I don't think so.
I think the government should send a clear message to
the transport society that road rage internal or external
would not be condoned. The driver should be punished.

When you're on the bus, the bus driver is the commander and chief, the
bus
driver have all the rights to detain or kick the passenger out of his
bus.
The principle that customer is always right does not apply here.

I read the newspaper report of this incident.
If the report is true then the boy is not at fault for
defending himself. The driver have no right under
the Singapore laws to detain anyone. However
he could detain anyone who had or is suspected
to have committed a crime. In that case the driver
could detain them and call the police. However
in this case it was the control station that called the
police. And if the driver want to legitimise the
detainment then he also need to inform the boy
and the girl that they are detained and that the police
are on their way. The driver did not declare his intention
and prevented the girl and the boy from leaving.

On two counts under the constitution of Singapore and
the penal code the driver had violated the laws of Singapore
when he obstructed and detained those kids. The boy
defended only after the driver got physical with them.
Now getting physical is not sanctioned under the law if no
crime is committed and the driver at that moment was just
following instructions from the control room and not of prior
knowledge of the law. Therefore the driver's actions were
entirely predicated upon ignorance and vigilantism and that
is only less than riot.

The driver is guilty of spoiling public peace.
Obstruction of path.
Unconstitutional detainment.

Would you take the word of a P65, who scored 4 points or better in his

minister in next cabinet, and maybe PM/SM/MM material, or would you
choose to believe a born loser type HDB heartlander destined to spend
