Singnet, pacnet, starhub is NOT a publisher.
They are ISP that transmits and mirrors postings
in Usenet.
I paid them n they provided the forum for the "publication" of my
defamatory materials.
Your ISP's did NOT provide the forum.
Usenet is the platform and Usenet is
NOT owned or controlled by your ISP.
In any case they did transmit my stuff and got
paid for it.
Trasmitting is NOT the same as publishing.
This is the same argument as a telephone
service, they just provide the service, they
do not control how it is used.
So what is the difference versus SPH and the like??
SPH is a publishing house, they have ALL
the control on what to publish and what they
do not want to publish.
Unlike your ISP.
They have no control over what is posted
unlike, publishers.
Can printer or publisher claim this relief?
No.
Publisher can refuse to publish.
Same with printer.
So they are deemed to have control
over the material.
They do have a choice of no transmitting...
Publishing houses, yes.
ISP and telecoms...NO.
Did they have disclaimer made known to sufers?
What disclaimer?
I think its in your contract about how
you are responsible for how you use
the internet.
Of course, they can be asked to remove
postings from THEIR own servers, but that
do not mean *** because mllions of other
servers contain the same posting and can
be easily accessed through other routes.
Thats the reason Usenet is so popular....it is
not so easily censored by anyone.
Have posters been successfully sued by the rich and powerful in sg?
I think yes.
Some of the old regulars here would know
for private summonses between posters.
As for being changed by the government,
there are 2 cases that I know of....robert's
case and one more involving defamation to
the MP's and Sinda.
Might as well sue singnet for allowing you
to access porn sites, download songs, or
see CSJ websites.
The visits are not unlawful.
Not quite accurate technically.
Whilst visiting is not unlawful, possession
of pornographic material in your computer
is.
It cannot be done.
If the cyber action were unlawful and gahmen choose to sue, little can
top them...
Depends on what kind of cyber action
that you mean.
Defamatory articles...yes.
Criminal activities....yes.
Unless Singapore wants to close all its ISP
and cut off communication from the rest of the world.
There are other ways to skin the cat.
Of course....but then you'd be going
in the way of China.
Is that what Singapore wants to do?
.
