I know a Jewish woman who owns a house that is so old
that the lease, blindly re-copied through successive sales,
still has the clause that "the owner will not sell to blacks
or Jews (WTTE)." She absolutely refuses to white it out,
because, to her, it's a mark of pride (& probably not a little
vengeance) to own such a house.


But when she or her heir(s) sell the house, it is possible that the title
company will want an affirmative statement from a court that such a clause
is unenforceable. If she "whites out" anything on a deed, she creates an
additional problem. The deed filed with the County Clerk is the official
deed and any physical changes to the document she has will generate
another legal fee.

If I were the owner, I would have taken steps long ago to have the deed
amended legally.

I believe Maryland (where Susan resides, so I'm assuming that's where the
other woman also resides) now has a statute that makes such clauses
unenforceable. Thus it is probably not a cloud on the title. Maryland is
where I went to law school and I think we talked about that (grumble,
grumble) years ago in Property class.
