Yes, it could be with no hei hayediah as in the poem. But that merely
states that He is "a" true judge. Dayan (with qamatz) haemes with hei
hayediah emphasises that He is "the" one and only true judge.
Why are you going to a piut, which might be different, and is a domain
that isn't really known for accurate transcription, when you can go to the
gemara that actually obligates the blessing and has work on ascertaining
authoritative text?
See Pesachim 50a (just at the end of the 3rd chapter "Eilu Overin").
It's "dyn h'mt".
The only debatable point is whether it's "Dayan" or "Dayon", or other
vowelization issues. I don't think it touches on this point, though.
If we were dealing with a noun-adjective pair, it would have been
haDayan haEmes. (Which sounds wrong, but I think "amiti" is only modern
Hebrew.)
When dealing with a semichut ("attached"), the noun is already
specified. Benei Yisrael becomes "the Children of Israel" even though
the Hebrew has no explicit "the", because in Hebrew, it's enough that the
"of Israel" specify which descendents we're talking about. And therefore
it's "Sar haTabachim" (the Leader of the Executioners; ie the head
executioner) in Gen 37:36, not haSar haTabachim.
And so here, "Dayan haEmes" must be semichut, "the Judge of truth", not
the noun-adjective, which would be "haDayan haEmes" (the True Judge) or
"Dayan Emes" (a True Judge).
