I don't know, maybe a shower works. You say mikvah is the only way - but
while it's certainly the only *O* way, we don't know if it is indeed the
only way.

But my actual point was regarding the presumption of not violating a
negative commandment. I don't think it's fair to convert the negative
commandment, don't approach your wife during menstruation, which ought to
fall under Jon's "don't ask / don't tell" policy, into a positive
commandment (go to the mivkah) that the community ought to be actively
monitoring.

And how do you know that they don't follow it? (using the principle of
applying the benefit of the doubt as you're doing above)

I just told you.

You know they don't follow the positive commandment of go to the mivkah -
you don't know if they do or don't follow the negative one of not
approaching.
