Madden & Finucane strike again. Two paragraphs of half-truths and
lies.
While the court ruled that the initial investigation had lacked
independence, it did *not* find any lack of transparency or
accountability on the part of either the RUC or PSNI. Indeed, there
has been regular contact between the police and the appellants and
their solicitors.
Nor did the RUC investigation conclude that Weir's allegations were
false.
An internal RUC report concluded that it would be necessary to
interview Weir before any view could be finalised in respect of the
credibility of his allegations: such interview was not possible as his
whereabouts were not known. The Serious Crime Review Team later
audited all known information and documentation and subsequently
passed the investigation to the Historical Enquiry Team. [see

The HET investigation into Weir's allegations continues.
The court found that there had been no undue delay in investigating
the allegations made by Weir and that: "if the matter has dragged on
from 1999 to 2007 this has largely been due to the lack of any strong
leads and difficulties in interviewing Weir, who remained outside the
[UK] jurisdiction. It is not apparent that there has been any wilful
foot-dragging or prevarication." [see paragraph 78: Brecknell v UK,

The court also expressed the view that there had not been any
significant oversights or omissions by the original RUC investigating
team. The key traceable witnesses have been interviewed, and the
available evidence collected and reviewed. "The Court is not persuaded
that the apparent errors or shortcomings of the RUC identified by the
applicant can be regarded as rendering the investigative process
inadequate when viewed as a whole." [see paragraph 79: Brecknell v UK,
