Paulo, let's assume for the sake of argument that the complaining
members of the media did have prior warning of some sort (perhaps some
sort of a vague tip, perhaps some in-depth advance info). Let's grant
that such prior knowledge of a planned illegal act might possibly have
obligated them to alert the authorities. Even granting that, does
posession of such advance prior knowledge justify action on the part
of the authorities excuse and/or justify (from the charges spoken of
above):
1. arbitrary arrest and detention
2. abusive and inhumane manner in carrying out the arrests
3. violation of R.A. 7438 concerning Rights of Persons Arrested set
forth therein
4. violation of press freedom
5. illegal confiscation of media equipment
6. grave misconduct and grave abuse of authority and discretion.
even if such misconduct was "part of operational guidelines"?
If operational guidelines include engaging in such misconduct, are not
such guidelines improper? Should not the persons engaging in the
misconduct be charged regardless? Should not the high level persons
who drew up the improper operational guidelines also be charged?
