Commission on Elections en banc yesterday issued a warrant of arrest
for Maguindanao election supervisor Lintang Bedol on criminal and
administrative charges.

Commissioner and Task Force Maguindanao chief Nicodemo Ferrer said
Bedol faces criminal charges for infidelity in the custody of public
documents. The penalty carries six years imprisonment.

"He took it upon himself to be the custodian when he collected the
documents," said Ferrer.

He said Bedol also faces administrative charges for contempt of the
poll body's repeated summons and subpoenas. The penalty is six months
in prison.

The criminal charges will be filed in Maguindanao. The Comelec's Law
and Personnel Department will handle the administrative charges.

"We hope he is ready to face us. Uulanin siya ng mga kaso. He was
given more than enough time to show up. Wala ng preliminary
investigation because we have done it already," Ferrer said.

Bedol, who is in his hometown of Cotabato City, on Sunday dared the
commission and his other accusers to file charges.

"If he is hiding, he should hide very well. We have the power to order
his arrest. For me, he is already a fugitive. We don't want this
fellow to be challenging this constitutional body," Ferrer said.

Bedol has been summoned and subpoenaed by the commission at least five
times. He appeared only twice.

When he appeared on June 11, Bedol sought permission to retrieve
remaining election documents in Cotabato City and bring them to
Manila.

He also promised to explain in writing his failure to attend
hearings.

Bedol has been tagged as behind the "statistically improbable" result
of the Maguindanao certificate of canvass where the Team Unity ticket
swept the senatorial race in the province.

The Comelec has enlisted the help of the NBI and PNP in effecting the
arrest.

Chief Supt. Florencio Caccam, chief of the PNP Firearms and Explosives
Division, said Bedol may be liable for illegal possession of firearms.
During a media interview, Bedol was photographed with a holstered gun.

Caccam said based on their records, Bedol does not have a permit to
carry firearms outside his residence or PTCFOR. He said Bedol has a
license to possess one short and one long firearm.

"You cannot display a firearm even if you are cloaked with the
authority to carry your firearm outside your residence. It must be
concealed," Caccam said.

"Hindi lang mare-revoke (gun license). If I were (ARMM regional police
director) Gen. (Joel) Goltiao, I would file a case against him for
violation of PD 1866 (firearms law) dahil wala naman siyang PTCFOR. In
the first place, bakit niya bibitbitin yung baril niya outside of his
residence?" he said.

Members of KontraDaya, supporters of Genuine Opposition candidate
Aquilino "Koko" Pimentel, leftist groups Bayan, Anakpawis, and Suara
Bangsamoro in around 50 vehicles, held a noise barrage around the
Comelec office in Intramuros, urging the poll body to stop the
inclusion of what they called the "highly tainted" Maguindanao
municipal COCs in the national canvass.

"It is so obvious that the Comelec made hocus-pocus in Maguindanao.
Abalos, Bedol and other Comelec officials have no credibility at all
to claim that what they have now are authentic election documents,"
KontraDaya convenor Fr. Joe Dizon said.

Former Vice President Teofisto Guingona, a ranking official of the
poll watchdog group, said it is not only the commission's
responsibility to count the votes but also to ensure and show the
public that the electoral process is credible.

Dizon and Guingona said they are wary of the attitude of Bedol in
daring the commission and his other accusers to file charges against
him.

"It is somewhat suspicious... It somehow shows na he has a hold on some
people na hindi na kailangang pangalanan kung sino," said Guingona.
