Palace defends possible use of emergency powers

AMID warnings from the business sector and allies in Congress,
Malacañang on Wednesday defended anew the use of emergency powers
should the energy crisis escalate.
Executive Secretary Eduardo Ermita said allowing President Gloria
Macapagal-Arroyo to exercise control over vital industries such as
power to deal with the crisis was allowed by the Constitution.

"Definitely, because that's allowed under our Constitution, in our
laws, in our administrative code," said Ermita. "The executive branch
has a lot of power and authority it can exercise to protect the general
[public]."

Justice Secretary Raul Gonzalez said earlier that he instructed his
chief of staff, Benny Nicdao, and State Prosecutor Jaime Umpa to study
the possible government takeover of oil and power firms, as well as air
and shipping lines in the event the oil crisis worsened.

Ermita said previous presidents also resorted to "emergency powers."

"All I know was that there was a resort to emergency powers in order to

Antonio Cuenco had warned of dire consequence should government push
through with the plan. He said it would not get the support of
lawmakers, even the President's allies.
