It is all IMHO a variation on GORT in the "Day the Earth Stood Still"
We simply announce that we will unilaterally consider any development or possession of nuclear weapons by any country a "potential threat" to the USA. We reserve the right to terminate any such possession at any time. We work with allies diplomatically to develop common strategies.
You've dodged. The paragraph above has been accepted in
international law for centuries (an action that changes the
balance of power against you significantly is a just cause for
war. It's in Kissinger's article too BTW.)

and my point is that the question is irrelevant.
it doesn't work that way
i.e. it does not depend on "action" reaching a "level"
that is your creation.
To use an imperfect legal analogy you are suggesting a "rule" and I am describing "Adjudication"
its like pornography, they know it when they see it.
