I agree. If, as appears to be the case, the plaintiff concedes that
Murtha
merely repeated what he had been told, there was no libel, it seems to me.
The lawsuit appears to have been a tactical ploy to get expedited
discovery
in the UCMJ case.
If Murtha was deliberately misinformed by officials from the executive
branch, is there a question of privilege related to an obstruction of his
duty as a member of Congress? Would this be the purview of the House rules
committee?
