I am not going to agree or disagree with you on whether or not gray market is
illegal. I do not know if it is or not.

I will be redundant, notice that I am not saying that gray market is legal, I
am saying that I do not know if it is legal.

In reference to US residents purchasing programming from providers outside the
US, I know of no legislation or FCC regulations that prohibit this ... and I
have searched for info about this repeatedly. I have seen statements at the FCC
web site that say that it is not illegal to receive foreign content in the US,
but these statements are very ambiguous. They make no mention of receiving
(purchasing) subscription programming.

I have contacted the FCC more than once and have asked them. They never
replied. A friend of mine has a contact inside the FCC, he has asked his
contact 2 or 3 times if gray market is illegal in the US, he also has never
received and answer.

I have also repeatedly done searched for info concerning Canadians purchasing
grey market programming. The only info I can find the mentions of grey
marketing via signal piracy, which clearly is illegal, and a few references pf
civil (not criminal) lawsuits in which Bell Expressvu sued DBS grey marketers,
this usually *but not always) also in conjunction with signal piracy.

I have found no instances of any Canadian marketers for big dish programming
being arrested or sued. I have seen no references that come close to saying
that anything other than DBS grey market is illegal. It is almost as if
Canadian big dish does not fit into the formula. But this also may only mean
that the number of gray market big dish subscriptions that may exist in Canada
is not significant so BEV, SC and the authorities are not concerned about them.


Examples of the type of info I find when searching for Canadians using gray
market are below.

The Radiocommunication Act and the Grey Market
In Canada, the DTH grey market refers to the sale and marketing of American DTH
satellite receivers and subscriptions to American services in Canada. The grey
market creates a number of difficulties for Canada. For example, it undermines
Canada's broadcasting policy for a distinctly Canadian broadcasting system, as
well as undermining jobs and growth in the Canadian broadcasting industry.

The Radiocommunication Act Section 9(1)(c) states: "No person shall...decode an
encrypted subscription programming signal or encrypted network feed otherwise
than under and in accordance with an authorization from the lawful distributor
of the signal or feed". This section of the Radiocommunication Act has been the
subject of recent court challenges involving retailers who sell American DTH
satellite receivers and services in Canada. This resulted in confusion due to
differing judgements rendered regarding the interpretation of section 9(1)(c).
A Supreme Court of Canada decision in the case of Bell ExpressVu v. Richard
Rex, made on April 26, 2002, confirms that provisions in the Radiocommunication
Act forbid the illegal decoding of satellite television programming.


1. Is it true that it is legal to import an American satellite dish?

If a satellite dish system is imported and intended to be used for unlawful
decoding of encrypted signals, as prohibited in section 9(1)(c) of the
Radiocommunication Act, this constitutes an offence under section 10(1)(b) of
the Act. It is illegal to use an American DTH satellite service (also referred
to as grey market) in Canada to receive and decode encrypted programming. Doing
so is in contravention of section 9(1)(c) of the Act.

Government of Canada Applauds Supreme Court Decision in the Case of Bell
ExpressVu vs Richard Rex
OTTAWA, April 26, 2002 - Industry Minister Allan Rock and Canadian Heritage
Minister Sheila Copps welcomed today's Supreme Court decision confirming that
provisions in the Radiocommunication Act forbid the illegal decoding of
satellite television programming.

"Today's Supreme Court decision helps preserve and ensure a strong and vibrant
Canadian broadcast industry," stated Minister Rock . "This is a blow to those
pirates of the airwaves that are selling or distributing illegal equipment
designed to steal satellite T.V. programming."

"The Supreme Court's decision supports the government's commitment to put an
end to signal piracy and grey market activities. It clearly is a gain for the
integrity of the Canadian broadcasting system," said Minister Copps. "These
illegal activities undermine the rights paid by Canadian broadcasters and put
at risk investments in Canadian programming that create jobs for Canadian
writers, performers and others involved in production."

The Government of Canada, in cooperation with the Canadian broadcasting
industry and law enforcement authorities, will work to stop the selling and
distribution of devices designed for the unauthorized decoding of satellite
television programming.

The Attorney General of Canada intervened in the case and presented arguments
that Section 9(1)(c) of the Radiocommunication Act protects both Canadian and
foreign signals from unauthorized decoding.
