Few get compensation under EU rules on delayed flights



According to "The Scotsman", 29 Nov. 2005:

99% of complaints about cancelled flights never get off the ground

"FEWER than 1 per cent of compensation claims for flight delays and
cancellations under new EU laws are successful, according to industry
figures which suggest the regulations are of little use to consumers.
Only six of the 1,347 claims submitted by British passengers under the new
rules have resulted in a pay-out because airlines are using a loophole which
exempts them in "extraordinary circumstances". (...)

James Freemantle, of the Air Transport Users' Council (AUC), said: "These
laws are in their infancy and it is unclear how airlines and civil courts
are going to interpret them. At the moment, airlines are using the loophole
to avoid pay-outs in exactly the kind of scenario the laws were designed to
cover."

He added the 1,347 claims processed by the AUC on behalf of passengers since
February was "a tenfold increase" on ordinary complaint levels and that many
other consumers had made claims directly to airlines. (...)"

Apparently, as flights are supposed to leave on time, all delays and
cancellations are deemed to be due to the "exceptional circumstances" that
exempt the airline from paying compensation!
So now we know what to expect... !
