The decision on wether or not the two remaining counts will go before a jury
hasn't been made yet. The judge has yet to decide on a motion of
prosecutorial misconduct which is directly related to the two remaining
charges. The two remaining charges are the ones that the first two grand
juries refused to indicte DeLay on.
