First of all, he was unarmed. The guy who killed him said as much.
Second, by law, your self-defense excuse ends when you are no longer
in harm. He apparently tried to kill him because he was "getting
up."

I don't have any quotes from the guy, myself. I don't know any more
than what was in the article. I saw the video, and I can see what I
believe is easily ascertainable. You can't be sure someone is unarmed
until they are searched. Particularly when they are on the ground,
where a weapon could be under them.

He is not. He is really neither until a judge decides to try him as an
adult or not. And that determination is usually 100% these days when
the juvenile is 16 or older, a weapon is shown, violence of any kind
occurs, and he is an active participant.

That would be applicable if the judge actually got to determine whether the
kid should be tried as an adult. Unfortunately, this cannot happen because
the pharmacist decided he didn't want to wait. Therefore, the
assailant/victim in this case is a child. There can be no other
determination in the matter.
