nowadays, the political branches have gotten lazy and deferred to the
judicial branch the (awesome) power to make a definitive determination
of whether a law is constitutional. back then, the notion was that each
branch had a responsibility to do so - it was considered an important
aspect of the separation of powers. that meant eg. that a congressman
would refuse to vote for bills he believed violated the constitution
(still happens occasionally), that a president would veto bills that he
believed did so (still happens occasionally). but beyond that, the
president was also supposed to make an independent judgement (i.e.,
independent of the opinion of congress or the judiciary) about laws
already in place and court decisions, and if necessary refuse to
implement or execute ones he believed violate the constitution (we never
see that).

yeah the government that rules the least rules best...

too bad these bastards got power hungry and like to obfuscate the
truth.
