You bet I know the difference. My right to be free of search without due
process of law is a constitutionally protected right. Their preference
not doing business with someone that would like to have a beer, a legal
beer, once in a while, is not.
Are you sure about that? Last time I checked, "imbiber of alcohol" isn't a
protected class.
I've read the constitution several times and never, ever, have I seen the
right to ban anything.
Is the business in question part of the government? If not, I'd say that
the ninth and tenth amendments would fit pretty nicely. They have the right
to limit their customer base in pretty much whatever way they see fit as
long as their exclusionary practices don't hinge on one of the protected
classes.
