He is correct, even if you think he has to be wrong.
You don't get to transfer ownership and that is why the monument
won't move. Once a property line becomes established by markers
and acceptance by the owners, it is the property lines that remain
a constant with time.
By now those boundary lines are "constructive" making them legal.
If that were true everywhere, there wouldn't be two different section markers at the NE corner of what used to be my farm. There is a new and an old one.
I've had the county surveyor come to my house to call the courthouse to ask which was the one he should be using.
There won't be a lawsuit only if the parties agree. If even one isn't happy with the boundaries, they'll be asking for a court's opinion.
I've sat through these disputes in the county courthouse and township hall. The officials assured property owners that the corrected survey
would not affect the old property lines. The original survey was well over 100 years old. The problem was that new surveys gave legal descriptions that
overlapped existing properties leaving 2 people owning the same property and both being taxed for it. Township and county officials had to change their tune.
If you were a property owner, how long would you stand for a situation where you were paying the taxes on land someone else was using? BTDT, gave the land away.
This particular situation may not arise in the 4 corners boondoggle if public land is involved and the states all decided to abide by an agreement.
Don't ever ask Janet for legal advice. She doesn't know the difference between liable and libel.

You do not move the corner markers that are in place just because
some new technology comes along that allows the position to be
determined more accurately.
