Nobody should be surprised. This ruling has been brewing for weeks.
The Texas Authorities flat screwed the pooch on how they handled
this. I sure as hell don't side with that sect and their practices.
But
we can't have our government using Jack Boot Tactics of swooping
in and wholesale scooping up every kid in sight whithout an individual
investigation into each case. Yeah, lotta work but you gotta know
that
some of those kids were grabbed and shoved into foster care whith
very poor cases and reasoning. You CAN NOT punish those even
if a few just to score the large haul of possibly the most that are
guilty.
It's a case of some Texas Child Care Authorities being lazy and
sloppy.
Now they have to start over and do their job correctly and some of the
guilty will slip away in that process.
I know this for damn sure. You DO NOT want to shove little kids into
Foster Care willy nilly on a whim. It can be VERY damaging to the
child. I know this on a personal basis. I had custody of two of my
grandchildren for a time. They were in separate Foster Care homes
in the Los Angeles County system when I petitioned the court for
custody. That system had them taken away from one of my daughters
who is an alcoholic. My grandkids were elated to get out of foster
care.
The oldest one asked us to "please promise me I never have to go
back to the fosters." They had been bounced around and separated
for months in that system. It ain't pretty! And yes I promised them
they would never go back.

Effectively, this was CPS's version of the Mt. Carmel [Waco] disaster but
without Janet Reno's intervention.
IMO - and that of many - CPS has the basic assumption that *no* parent
should be permitted to raise their own kids and that it's CPS' *duty* to
*protect* every child by yanking them away from their parents and placing
them with strangers.
From the outset it was obvious that no "probable cause" existed since thenotional complainant did not exist and the phone call was traced to an
out-of-state activist. [In Texas, at least, the filing of a false report
is a Felony but, to date, there's been no hint of any attempt to
extradite the over-30 woman who placed the call.]
With no "probable cause", Law Enforcement personnel had no right to be on
the property at all, much less interfere with the residents and *that*
was the key factor in the Appellate Court decision since, without it, the
rest of the case was meaningless.
It'll be interesting to see what the Texas Supreme Court has to say about
it *if* the State decides to appeal this decision.
Personally, I'd advocvate charging the CPS personnel - from the top on
down to the "Case Workers" involved - with Kidnapping.
