They all have the capability of recording while playing.

You appear to have concluded that this was the specific nature of the
patent found to have been infringed. I have not yet located an article
with such specifics, have you?

If it was indeed one of those broad software patents that cover
concept and not just hardware implementation, you would be right, and
it wouldn't be the first time that Microsoft had to pony up. Recall,
though, is not likely - just the payment of money by Microsoft to keep
doing what they do.

The draconian court orders that have hit Dish in the past couple of
months (shut off all Distant Networks, turn off DVRs) has not been
because they are infringing, but rather because they have been found
to be willfully and knowlingly thumbing their noses at the rules and
patents. That is what is coming back to bite them in the rear.

I would not be surprised if, at some point, they will be able to solve
it with money, with no disruption to customers, but I very much doubt
they will prevail in court based on the harsh nature of the rulings.
In the DNS case, as they've reached higher in the appeal process, the
appellate courts have been saying the punishment wasn't harsh enough -
hit them harder!
