Hey...well that's a good thing! Happy to hear you got a positive
result.
And also happy to share my previous experiences in this regard.

I just happen to have been in a position to have to learn the how on
some of that. A lot of that was from being self employed and running
our own business for a long number of years, being a landlord of some
rental property and also an owner of a large 3/4 acre home in Walnut
Creek for 20 years where we ran our business and had "stuff" come up.

"Stuff" like a landscape contractor that used faulty materials, the
flood
control district that caused our home to flood, flakey tenants and
a customer that wrongly sued us.

It's too bad that some folks think they can just get away with "stuff"
and think or hope you will "just go away." Silly us...(Carol and I),
decided early on that we would learn how to stand up for ourselves
and what we think is fair and right.

One time, I took a tenant to small claims because they were just
so blatently trying to screw us. The court gave me a judgement
against them. I never tried to collect on that one. They had little
or no money, were kinda down on their luck it seemed and I
could see no real advantage in hassling them any further. More
than anything on that one, I just wanted them to know they were
very wrong and had done something that was not right and fair.
My way of perhaps helping them towards an "attitude adjustment"
I hoped. 8^)

Hopefully you won't have to go to Small Claims Court. But if you do
it sure is a decent thing for common folks that just want to get some
justice without having to shell out tons of cash and have lawyers
involved. Anytime you can avoid that... sure is a good thing.

There have been a couple of times for Small Claims situations when
we did go to an attorney for advice just to make sure we were on the
right track and on solid ground with our legal thinking. Many times
if you need that advice you can even get one free consultation by
going through your local Bar Association's referral service.

Another thing all of those experiences taught us, was to be more
aware of how to avoid getting into situations where you might have
to actually go to court. Many times we have found that you can
avoid problems if you work things out with others long before you
get to that point.

Good job Ben!

Thanks again. To clarify, I'm not sure they are going to pay but they are
talking to me. They want to look at it again.. I agreed to taking it in
next week.

Another option I have since I paid with AMX is to contest the entire
payment. I told them in the letter that was an option I was considering. The
amount of that is greater than what I'm asking for though. It behooves them
to pay me off directly. But there is the issue not of them cutting too much
off the facia grill but that something is hitting when the car starts that
wasn't hitting before I brought it into them. I thing it's likely a minor
issue as the instructions clearly state they have to move a few things
during installation and my bet is that they didn't move anything if it would
fit, however close. So they want to look at that issue. I think they will
pay for the front facia but I believe they are trying to find a better deal
for the work to be done. Not sure I'm going to agree with that. In all
honesty, I was surprised about the good response from my very carefully
worded letter to them. Normally I stew about these type things, try to talk
with them. Most of the time, that's all that you need to do. I've been known
to get frustrated and then give up thinking I can live with it. Not this
time.. I realize now that I can write a pretty damned good pointed letter
regarding legalities when I put my mind too it. Should not really be a
surprise to me since I write procedures all the time for work.

Ben
