Sheesh...
I'm sorry, but you are misinformed.
The RIAA sends cease-and-desist letters threatening 'litigation' if
the parties do not agree to 'settle' They do NOT offer the
opportunity for the party to cease and desist without having to
settle. Big difference.
And that is appropriate. A guy steals your car, and you think it's
cool to ask him not to do that anymore, but not get your car back, or
any compensation therefore?
Here is a real analogy. Someone takes a photo of custom work you did
on a car and posts the pics on a file sharing network. You find out
and contact them and say, thanks for the all that free exposure you
gave my creation, but I don't want you to distribute pictures of my
work without prior authorization and/or compensation. If you agree,
case closed.

Sounds reasonable, but it's apples and oranges. The difference is scale.
It would be a massive undertaking to C&D every individual involved in
piracy and verify compliance. It's cheaper to make a few examples and go
after the services providing the medium.
Its a very complex problem.
People are working overtime (mostly because of greater broadband
access) on finding workable compensation models.
Here is one thing a couple of the BigBoys are going to try out.
June 2009
"Universal, the largest recording company in the world, said it would
offer its entire catalog — which contains works by artists like Amy
Winehouse and U2 — to customers of Virgin Media for a monthly
subscription.
The music will be free from copy protection, a feature that
distinguishes the service from most existing subscription offerings.
The cost of the service, which will probably start by the end of the
year, was not disclosed.
In return, Virgin Media, the British cable television and broadband
provider, agreed to take steps to reduce piracy on its network,
something that other broadband providers have resisted.
The measures could include temporary suspensions of offenders’
Internet connections, the company said."
