I need to read your posts very carefully these days to realise just
how little relevant material they contain. But the more I do read
them, the more I come to the conclusion you are arguing simply for
arguments's sake.

None of this has any bearing on what we are discussing here, which is
whether sajankhan's post can be considered spam or not.

You are the one who invoked CANSPAM, you are the one who pointed to S.
6, and when it became apparent that concerned post didn't fall within
the provision, you start talking about the server end. The server end
is not in question here, it is the act of the sender (sajankhan) and
its legality we are concerned about.

Neither are we talking about spoofing or other offences committed in
the course of transmission. What we are talking of is spamming, as
defined by S. 6 of CANSPAM (once again remember, you are the one who
invoked this provision). The offence stated in this section is
completed the moment the offending mail is set in transmission.
Spoofing constitutes an altogether separate offence which S. 6 does
NOT cover.
