There's a difference between performing it myself and publishing it for distribution. I may be willing to do one but not the other.
In days of old there was a requirement to publish at least 2 copies (which were placed in the library of congress) to establish copyright
Long past, and probably unreasonable.
And in fact, if you are to charge someone with copyright violation then you MUST publish your document, By placing it in the court record.
My understanding is that one only has to show sufficient evidence to demonstrate the violation, which may not be the whole work. (But IANAL so I'm not going to debate that further.)
And for some folks and some situations there's a difference between voluntary publication and having been forced to take action.
Whether you think my hypothetical decision to publish or not publish is reasonable or not, it's both legally and ethically defensible. The fact that it may be inconvenient for you would simply Not Be My Problem. Cope. Write your own.
