Umm, Article I, Section 8, Clause 8:

(Congress shall have the power) To promote the Progress of Science and
useful Arts, by
securing for limited Times to Authors and Inventors the exclusive

Granting that the *words* 'copyright' and 'patent' are not used, your
statement seems nonetheless questionable, to say the least.

Copyright didn't exist until the late 19th century...

Where? It seems the first copyright statute was enacted in Britain in the early
1700s:

IN the US - the question here was regarding the US Constitution.
