Umm, Article I, Section 8, Clause 8:
(Congress shall have the power) To promote the Progress of Science and useful Arts, by
securing for limited Times to Authors and Inventors the exclusive
Right to their respective Writings and Discoveries;
Granting that the *words* 'copyright' and 'patent' are not used, your
statement seems nonetheless questionable, to say the least.
Copyright didn't exist until the late 19th century...
