It's the difference between buying a service and an object.


The record companies don't want to actually tell you whether you are
buying an object or merely a license to content, they prefer to keep it
vague, and use the interpretation that best suits them at any given time.

If you are buying a physical object, you should be able to copy it at
will - it's yours, after all. But they don't want to let you.

If you're buying a license, and you lose the object, you should be able
to request a new one. After all, you never owned it anyway, just the
information it contained. Good luck getting them to give you one, even
if you pay the pittance it costs to manufacture it.

It's neither a physical object nor a license, but specifically, a
copyrightable work (or "published" work). More like a book. You can
loan a book to your friend and give it away, but you can't copy it on a
printing press and bind it and sell copies.

A license is specifically a contract you enter into. Software
companies have blurred this distinction somewhat by some courts
accepting "shrinkwrap licenses," which appear to be binding simply by
you opening a package or breaking a seal. As yet, there are no legal
agreements in CDs, so it would be hard for a record company to claim
rights insofar as a "license."
