He doesn't get to make that choice. And once he's there, he doesn't get to
make the decision on whether the question was "proper" or not. Lying under
oath in a court of law constitutes perjury whether he "should have been
there" or not, whether the question was "improper" or not.
It's perjury and it's a felony.
