Is this idea commonly practiced? Personally, I would object to
participating in a recreational juggling event that claimed ownership of
my image, performance or media where I appeared. The potential for
misuse, and mostly from the general attitude, would put me off from
attending.
Is it really necessary to have such a declaration in place? The use of
media generated from a juggling festival is a subject that has come up
time and time again in the IJA and their practice of selling festival
videos for profit, so I realize that there is something at stake here.
Where are the participants rights in this formula?

Hey Steven, thanks for bringing up the issue. I've actually been thinking
long and hard about it...
The following problems I've been facing as organizer of last seasons
festival:
1) We were too busy to prepare much footage in order to use it for
promotion of the event (on the website) because... well I did everything
myself.
2) People were recording the event with (semi)professional equipment and I
couldn't get copies to use...
Now I would like to ask you: how fair is that? Not just for organisation
but also to the performers (of the Gala Show for example) who made a
fantastic appearance and couldn't get any good material to use it for
their own promotion.
(sorry for gaining some length now)
- Most performers I know have difficulties to get decent material. Here I
at least aim to help out, all material will be available at no cost to the
artists.
- Those performers, who eagerly want to protect their act and retain
control on all material released about their appearance ([sic] please note
that not all of the material released may be complimenting the person or
act displayed) will find that their rights are being protected by this
term.
As organizer of the InJuCo (whose first language is not English - thanks
for taking this into consideration) I aim to solve most of these problems
and this by retaining all rights of material taken on the event, may it be
stills, motion or sound (we also have musicians playing).
I will display this condition upon entry and kindly ask (professional)
photo/filmographers to register for a permit in advance (esp. those who
have an SLR for example). I provide a 500GB hard drive on the convention
and request share of material recorded. If it is not shared, the permit
will instantly expire. As I hold all copyrights on all material (released)
I can stop people from publishing material which the artists don't like to
have published (or at least force their withdrawal).
I acknowledge that some ppl don't wish to be videotaped or photographed
and however will not release any material that diminishes a persons
integrity. However I will not be able to ask every single person for their
individual consent or allow them to file for compensation once material
got released. I will ask every artist to register and will notify him
about the release of material, allow them to review and to object. But
this is voluntary and based upon 'goodwill'.
However: Please kindly note that this is a non-profit event anyway (I
reckon most Juggling Conventions/ Festivals are) and that any profit
coming out of this will be used to perpetuate the event (so far everything
is prefinanced by ... me) and to fund community based projects (last
conventions profits - INR 10.000 - got fully donated to a schooling
project for "travelling children", children whose parents come to Goa to
work here in the season, don't speak the local language and would have to
sacrifice their academic career, if not this schooling project would
provide them tuition in their own language - I know that's only 180 ?, but
it's an (over) average Indians 3 month salary... and tickets sold at a
mere ? 1,80)...
This year the artists are facing up to 80% cancellation of shows due to
the Mumbai attacks. Therefore I agreed that all profit generated from
tickets sold after 6pm or on the Gala show will benefit the performers.
Sorry that I didn't get into that much detail on the website. I aim to
make this an event where everybody attends happy and smiling and with good
faith/ an open heart.
This event is just happening the second time - only now I was able to form
a group as ppl see it's not merely a phenomenon. So far it's my brainchild
- under the imprint of the most amazing EJC's - now I aim to get the
bugger walking on it's own feet with (your) help. Any input, constructive
criticism, food for thought, kind slaps on the cheek are highly
appreciated - especially from within the community... (i.e. 'you') :o) No
offence meant and definitely none taken...
I want to keep this event casual, won't police it restrictively and feel
the need to inform ppl upfront (so they police themselves).
Hope this answered most of your concerns and beg your pardon for sounding
like a lawyer... :o)
