That doesn't sound quite correct to me. --Not being a lawyer, I
won't/can't argue the point but I will pose the question to an
acquaintance of mine if an opportunity arises.
That said, the out of court settlement looks like damage control to me.
They want to get out before they wind up in a constitutional pickle.
Let me save you some time, it ain't precedent.
I'd presume that it went to small claims to avoid The Dark Tyranny's
financial clout. If enough awards are granted under small claims, it
should eventually embolden someone to go after Monsanto for more. The
only way to stop more GMOs is to make it too expensive for them to
continue.
