Re: USCF wants me refiling in Illinois?

Hmm, at least one defendant is challenging service of prrocess here.

Illinois has a two-year statute of limitations for defamation claims.

ISPs have NOT been ruled immune under Section 230 in the Seventh Circuit.

Don't be any more of an idiot than you have to. The 7th Circuit has
been _slightly_ less favorable to 230 cases, but that just means
nibbling around the edges. (Exactly how much do you have to contribute
to become a "content provider"?) No judge is going to go against ten
years of case law (which SCOTUS has consistently refused to overturn).

Yet the SCOTUS has also refused to AFFIRM it.

The real case law on distributor libel dates back 150 years and does not
favor immunity. The courts have been LEMMINGS on the issue to build that
"case law" which increasinly looks like a mistake.

You can say "Obama's a Muslim" now and link to some obscure site whee it was
said, once, and supposedly you're immune? Ridiculous.

Section 230 never envisioned Google, that's for sure. In fact, the immunity
was given to override the court decision against Prodigy, but that dealt
with "automated" distribution rather than republished distribution with
foreknowledge etc.

Now what if the source is anonymous? It means you can't sue the source,
can't sue the republishers, and basically have no rights. Libel laws were
passed as a replacement for DUELING, so the legislative history recognizes
what's at stake.

Two female yale law students, in a lawsuit filed by law professors at Yale,
are attacking the immunity in the "Autoadmit" case. The 7th circuit has
shown that it may very well jump ship on this issue and force it to the US
Supreme Court.

Maybe if Obama loses this election and blames the "lies" for the loss, he'll
go to the senate and get the ball rolling on some real reform. The problem
is that rich people can fight back, so they don't feel the need to protect
the commoner.

Beware! VH-1's "The Pickup Artst" was FRAUDULENT. Six of the eight
contestants were actors, and they used PAID TARGETS in the club. The paid
targets got mad when VH-1 said "there are no actors in this club" and ruined
their prromised acting credit. What else has Mystery lied about?
