I know that poker is considered gambling and is illegal to play online
in most of America. I have a few questions about it. I've played with
money for money before i knew of this gambling law. Now i don't play
with money but I do play in freerolls for money. Can I collect my
winnings or would that be considered "gambling"? Since the WSOP is
coming up I try my hardest to find time to play and win a seat. If I
do win a seat for the WSOP can I use it? Could I be held accountable
for a free game if i want to cash in on my winnings?
Poker is not illegal gambling in most places in America, online or not.
But that is really not the question. The question is, can I play a game
of chance, where I have not put up any money, and take the winnings.
Maybe. This depends on your local rules/laws. Essentially it usually
comes down as to what the interpretation of consideration is. Some
jurisdictions will state that merely taking the time to play, or to
provide information that can be used by the game provider to be
consideration, and therefore gambling.
Some don't.
Why consideration? Isn't consideration just required for a contract?
